General Terms and Conditions of Business

1. Scope of application

For all orders via our online store by consumers and entrepreneurs, the following terms and conditions apply.

A consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to his commercial nor to his independent professional activity. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his commercial or independent professional activity.

With respect to entrepreneurs, these GTC shall also apply to future business relations without our having to refer to them again. If the entrepreneur uses conflicting or supplementary general terms and conditions, their validity is hereby objected to; they shall only become part of the contract if we have expressly agreed to them.

2. Contractual Partner, Conclusion of Contract

The purchase contract is concluded with Funduino GmbH.

By placing the products in the online store, we do not make a legally binding offer to conclude a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before sending your binding order by using the correction aids provided and explained for this purpose in the order process. Immediately after sending the order, you will receive another confirmation of receipt by e-mail. 

We accept your offer within two days by issuing a declaration of acceptance in a separate e-mail or, if applicable, by executing the payment transaction through our service provider or the selected payment service provider. The time of execution of the payment transaction depends on the respective selected payment method (see under "5. Payment").

The relevant alternative for you depends on which of the listed events occurs first.

3. Contract language, contract text storage

The language available for the conclusion of the contract is German.

We store the contract text and send you the order data and our GTC by e-mail. You can also view and download the GTC at any time here on this page. You can view your past orders in our customer login.

4. Terms of delivery

Shipping costs will be added to the indicated product prices. You will find more details about the shipping costs at the offers. We deliver only by mail order. A pickup of the goods is not possible.

5. Payment

In our store you can choose between the following payment methods:

Prepayment

If you choose the payment method prepayment, we will tell you our bank details in a separate e-mail and deliver the goods after receipt of payment.

PayPal Plus

Within the framework of the payment service PayPal Plus we offer you different payment methods as PayPal Services. You will be redirected to the website of the online provider PayPal. There you can enter your payment details, confirm the use of your data by PayPal and the payment instruction to PayPal.You will receive further instructions during the ordering process.

If you have chosen the payment method PayPal, you must be registered there to be able to pay the invoice amount or register first and legitimize with your access data. The payment transaction is carried out automatically by PayPal immediately after confirmation of the payment instruction.

If you have chosen the payment method credit card, you do not have to be registered at PayPal to pay the invoice amount. The payment transaction will be carried out by your credit card company immediately after confirmation of the payment instruction and after your legitimation as a legal cardholder at the request of PayPal and your card will be charged.

If you have chosen the direct debit payment method, you do not need to be registered with PayPal to pay the invoice amount. With confirmation of the payment instruction you give PayPal a direct debit mandate. You will be informed by PayPal about the date of the account debit (so-called prenotification). By submitting the direct debit mandate immediately after confirmation of the payment instruction, PayPal requests its bank to initiate the payment transaction. The payment transaction is carried out and your account is debited.

If you have chosen the payment method invoice, you do not need to be registered with PayPal to pay the invoice amount. After successful address and credit check and submission of the order, we assign our claim to PayPal. In this case, you can only pay PayPal with debt-discharging effect. For payment processing via PayPal apply - in addition to our terms and conditions - the terms and conditions and privacy policy of PayPal. SOFORT bank transfer

After placing your order you will be redirected to the website of the online provider SOFORT Überweisung. In order to be able to pay the invoice amount via SOFORT Überweisung, you must have an online banking account with PIN/TAN procedure that is activated for participation in SOFORT Überweisung, you must legitimize yourself accordingly and confirm the payment instruction to us. You will receive further instructions during the order process. The payment transaction will be carried out immediately afterwards by SOFORT Überweisung and your account will be debited.

Purchase on account

The payment method "invoice" is only available for educational institutions.

Purchase on account with Klarna

In cooperation with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, we offer the following payment options. The payment is made to Klarna in each case:

  • Invoice: the payment period is 14 days from the date of dispatch of the goods/ticket/ or, in the case of other services, the provision of the service. 

The use of the payment methods invoice and direct debit requires a positive credit check. In this respect, we forward your data to Klarna as part of the purchase initiation and processing of the purchase contract for the purpose of address and credit assessment. 6.Retention of title

The goods remain our property until full payment.

7. Warranty and guarantees

The statutory law on liability for defects applies. Information on any applicable additional warranties and their exact conditions can be found with the product and on special information pages in the online store.

8. Liability

For claims based on damages caused by us, our legal representatives or agents, we are always liable without limitation. In case of injury to life, body or health, in case of intentional or grossly negligent breach of duty, in case of warranty promises, if agreed, or if the scope of application of the Product Liability Act is opened.

In the event of a breach of essential contractual obligations, the fulfillment of which is a prerequisite for the proper execution of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations) due to slight negligence on our part, on the part of our legal representatives or vicarious agents, liability shall be limited to the amount of the damage foreseeable at the time of the conclusion of the contract, the occurrence of which must typically be expected. Otherwise, claims for damages are excluded.

9. Dispute resolution

The European Commission provides a platform for online dispute resolution (OS), which you can find here http://ec.europa.eu/consumers/odr/. We are neither willing nor obligated to participate in an out-of-court arbitration procedure before a consumer arbitration board. 

10. Miscellaneous

Our offered products are exclusively intended as tools for development under laboratory conditions. Specialized knowledge is required for use or commissioning.

Notes on discount promotions and vouchers

  1. Discount promotions (including explicitly the discount by belonging to the "customer group education") are generally not combinable with other promotions or vouchers.
  2. Our discount promotions and vouchers can in principle only be redeemed once per customer.
  3. Cash payment or subsequent offsetting of a voucher against previous orders is not possible.
  4. The following applies to the sale of discounted promotional goods: sale only in household quantities, while stocks last. We reserve the right to withdraw from the contract of sale, insofar as this household quantity has been exceeded.

11. Final provisions

If you are an entrepreneur, German law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
If you are a merchant within the meaning of the German Commercial Code, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from contractual relationships between us and you shall be our place of business.
