General Terms and Conditions

1. Scope of application

The following terms and conditions apply to all orders placed via our online store by consumers and entrepreneurs.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside his trade, business or profession. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.

These GTC shall also apply to future business relationships with entrepreneurs without us having to refer to them again. If the entrepreneur uses conflicting or supplementary general terms and conditions, their validity is hereby rejected; they shall only become part of the contract if we have expressly agreed to them.

2. Contractual partner, conclusion of contract

The purchase contract is concluded with Funduino GmbH.

By placing the products in the online store, we are not making a legally binding offer to conclude a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the order process. Immediately after sending the order, you will receive a confirmation of receipt by e-mail. 

We will accept your offer within two days by issuing a declaration of acceptance in a separate e-mail or, if applicable, by carrying out the payment transaction through our service provider or the selected payment service provider. The time of execution of the payment transaction depends on the selected payment method (see under "5. Payment").

The relevant alternative for you depends on which of the events listed occurs first.

3. Contract language, contract text storage

The language available for the conclusion of the contract is German.

We save the text of the contract and send you the order data and our GTC by e-mail. You can also view and download the GTC at any time here on this page. You can view your past orders in our customer login.

4. Terms of delivery

Shipping costs are added to the indicated product prices. You can find out more about the shipping costs in the offers. We only deliver by mail order. It is not possible to collect the goods yourself.

5. Payment methods

The following payment methods are available in our store:

Prepayment

If you choose to pay in advance, we will send you our bank details in a separate e-mail and deliver the goods after receipt of payment.

PayPal Plus

As part of the PayPal Plus payment service, we offer you various payment methods as PayPal services. You will be redirected to the website of the online provider PayPal. There you can enter your payment details, confirm the use of your data by PayPal and the payment instruction to PayPal; you will receive further instructions during the ordering process.

If you have selected the PayPal payment method, you must be registered there or register first and legitimize yourself with your access data in order to be able to pay the invoice amount. The payment transaction will be carried out automatically by PayPal immediately after confirmation of the payment instruction.

If you have selected the credit card payment method, you do not need to be registered with PayPal in order to pay the invoice amount. The payment transaction will be carried out by your credit card company at the request of PayPal immediately after confirmation of the payment instruction and after your legitimation as the legitimate cardholder, and your card will be charged.

If you have selected the direct debit payment method, you do not need to be registered with PayPal in order to pay the invoice amount. By confirming the payment order, you give PayPal a direct debit mandate. You will be informed by PayPal about the date on which your account will be debited (so-called prenotification). By submitting the direct debit mandate immediately after confirmation of the payment instruction, PayPal requests its bank to initiate the payment transaction. The payment transaction is carried out and your account is debited.

If you have selected the invoice payment method, you do not need to be registered with PayPal in order to pay the invoice amount. After a successful address and credit check and submission of the order, we assign our claim to PayPal. In this case, you can only make payment to PayPal with debt-discharging effect. In addition to our GTC, PayPal's GTC and privacy policy apply to payment processing via PayPal. SOFORT bank transfer

After placing your order, you will be redirected to the website of the online provider SOFORT Überweisung. In order to be able to pay the invoice amount via SOFORT Überweisung, you must have an online banking account with PIN/TAN procedure activated for participation in SOFORT Überweisung, legitimize yourself accordingly and confirm the payment instruction to us. You will receive further instructions during the ordering process. The payment transaction will be carried out immediately afterwards by SOFORT Überweisung and your account will be debited.

Purchase on account

The payment method "invoice" is only possible for educational institutions.

Purchase on account with Klarna

In cooperation with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, we offer the following payment options. Payment is made to Klarna in each case:

  • Invoice: The payment period is 14 days from dispatch of the goods/ticket/ or, in the case of other services, provision of the service. 

The use of the invoice and direct debit payment methods requires a positive credit check. In this respect, we forward your data to Klarna for the purpose of address and credit checks as part of the purchase initiation and processing of the purchase contract. 6. Retention of title

The goods remain our property until full payment has been received.

7. Warranty and guarantees

The statutory liability for defects applies. Information on any additional guarantees that may apply and their exact conditions can be found with the product and on special information pages in the online store.

8. Liability

We are always liable without limitation for claims based on damage caused by us, our legal representatives or vicarious agents. In the event of injury to life, body or health, in the event of intentional or grossly negligent breach of duty, in the event of guarantee promises, insofar as agreed, or insofar as the scope of application of the Product Liability Act is opened.

In the event of a breach of essential contractual obligations, the fulfillment of which is essential for the proper execution of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations) due to slight negligence on our part, our legal representatives or vicarious agents, the amount of liability shall be limited to the damage foreseeable at the time of conclusion of the contract, the occurrence of which must typically be expected. Otherwise, claims for damages are excluded.

9. Dispute resolution

The European Commission provides a platform for online dispute resolution (OS), which you can find here http://ec.europa.eu/consumers/odr/. We are neither willing nor obliged to participate in an out-of-court arbitration procedure before a consumer arbitration board. 

10. Miscellaneous

The products we offer are intended exclusively as aids for development under laboratory conditions. Specialist knowledge is required for use or commissioning.

Notes on discount campaigns and vouchers

  1. Discount promotions (including explicitly the price reduction for belonging to the "Education customer group") cannot generally be combined with other promotions or vouchers.
  2. The voucher code for newsletter registration can only be used for Funduino products. Products from other manufacturers (including explicitly the manufacturers Thymio, Variobot and FLUX) are excluded from the discount through the newsletter voucher. 
  3. In principle, our discount campaigns and vouchers can only be redeemed once per customer.
  4. Cash payment or subsequent offsetting of a voucher against previous orders is not possible.
  5. The following applies to the sale of discounted promotional goods: sale only in normal household quantities while stocks last. We reserve the right to withdraw from the purchase contract if this normal household quantity has been exceeded.

11. Final provisions

If you are an entrepreneur, German law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
If you are a merchant within the meaning of the German Commercial Code, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from contractual relationships between us and you is our registered office.
